Approved form of the protocol on violations of legislation norms regarding the content of bio-components in fuel
Ukraine continues to actively develop the alternative fuel market by introducing mandatory requirements for the use of liquid biofuel in the transport sector.
Last year, the Verkhovna Rada of Ukraine adopted Law No. 3769-IX, which established norms regarding the mandatory use of liquid biofuel (bio-components) in transport. Accordingly, starting May 1 of this year, all gasoline sold at filling stations (except for gasoline with an octane number of 98 and above and some special exceptions) must contain at least 5% bio-components.
The law also provides for mandatory accounting of bio-component content in gasoline and introduces administrative liability for:
- non-compliance with the requirements regarding the mandatory share of biofuel;
- untimely or complete failure to submit information about the actual content of liquid
- biofuel (bio-components) in the released volumes of motor gasoline from production sites or wholesale fuel trade.
The State Energy Efficiency Agency of Ukraine (Derzhenergoefektyvnosti) is responsible for administering information on untimely or incomplete submissions.
Currently, Derzhenergoefektyvnosti is actively working on creating a quality and transparent regulatory framework for the circulation of biofuels in the market.
«Our goal is not just to adopt rules but to ensure their fair and effective implementation. Together, we are shaping a strong energy independence policy and creating a transparent environment for the development of biofuel in Ukraine,» emphasized Deputy Head of Derzhenergoefektyvnosti Viktor Bilko.
Thus, on May 15, 2025, Derzhenergoefektyvnosti issued Order No. 99-25, which approved the form of the protocol on administrative violations.
On May 22, 2025, the order was registered with the Ministry of Justice of Ukraine under No. 792/44198.
The approved form of the protocol is a key tool to ensure effective control over compliance with legislation requirements in the biofuel sector.
This approach will allow:
- strengthening control over the transparency of the fuel market;
- ensuring responsibility of market operators for compliance with environmental norms;
- creating prerequisites for sustainable development of the biofuel sector;
contributing to the reduction of harmful emissions in the transport sector.
Starting July 1, 2026, administrative liability with possible fines up to 110 subsistence minimums for able-bodied persons will be imposed for violation of this legal norm.
The next step is the approval of the corresponding technical regulation.
For this purpose, a draft resolution of the Cabinet of Ministers of Ukraine titled “On Approval of the Technical Regulation on Requirements for Motor Alternative Fuels” has already been developed.
This technical regulation will provide:
- clear requirements for the quality, labeling, circulation, and certification of alternative fuels (bioethanol, biodiesel, fuel blends with high bio-component content);
- compliance with environmental sustainability criteria: limitations on greenhouse gas emissions, protection of land resources, transparent origin of raw materials;
- compliance with national and international standards, which will help avoid environmental harm and improve consumer protection.
Currently, the draft technical regulation is undergoing approval procedures with interested central executive authorities and has been notified to the World Trade Organization (WTO) according to the WTO Agreement requirements and Ukraine’s international obligations regarding possible technical barriers to trade.
The implementation of clear requirements for the use of motor alternative fuels will be another step towards green transition, energy independence, and Ukraine’s integration into the European energy space.
